These Terms of Service (hereinafter referred to as "Terms") set forth the conditions for using the service (hereinafter referred to as "Service") provided by Dermassy (hereinafter referred to as "we," "us," or "the App"). By using the Service, users agree to comply with these Terms.

1. Applicability

These Terms apply to all relationships between the user and the App regarding the use of the Service.

2. User Registration and Responsibility

A contract for use is established when a person wishing to use the Service agrees to these Terms and completes the registration process via the method prescribed by us.

Users are responsible for managing their own account information.

Users shall be solely responsible for all actions taken through their account and the consequences thereof.

3. Nature of Service and Disclaimers

  • Not Medical Advice: The skin analysis and AI-generated responses provided by the Service are for informational purposes only and do not constitute medical diagnosis, treatment, or professional medical advice. The Service is not a medical device.
  • No Warranty of Accuracy: We do not guarantee the accuracy, completeness, or usefulness of information generated by the AI. Users must consult with a qualified healthcare professional before making decisions regarding specific skincare products or medical treatments.
  • Limitation of Liability: To the maximum extent permitted by law, we shall not be liable for any damages (including skin issues, emotional distress, or financial loss) arising from the use of the Service. In the event we are held liable, our liability shall be limited to the total amount paid by the user to us in the month preceding the occurrence of the damage.

4. Paid Content and Subscriptions

Users can access specific features by purchasing a paid subscription.

Pricing and payment methods are governed by the respective app stores (Google Play / Apple App Store).

  • Cancellation: To avoid being charged for the next period, users must cancel the subscription through the app store settings before the renewal date. Deleting the App does not automatically cancel the subscription.
  • Refunds: All sales are final. We do not offer refunds for any payments already made, except where required by local law.

5. Prohibited Conduct

Users shall not engage in the following acts:

  • Acts that violate laws or public order and morals.
  • Acts that place an excessive load on our networks or systems.
  • Representing AI-generated information as medically proven or verified facts.
  • Impersonating other users or entities.

6. Modification and Termination of Service

We reserve the right to modify or terminate the Service at any time without prior notice. We shall not be liable for any disadvantage or loss incurred by users due to such changes.

7. Changes to the Terms

We may modify these Terms at any time without notice. By continuing to use the Service after changes are posted, the user is deemed to have accepted the revised Terms.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Japan.

Any disputes arising from or in connection with the Service shall be subject to the exclusive jurisdiction of the courts in the location of the provider's headquarters.
